Terms of Service — numbup Alpha

By installing and using the numbup Alpha build, you agree to these terms.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Alpha build on your own personal device, solely for testing purposes. You may not:

You must be at least 16 years old to use numbup. Where the law of your country, or the age rating the app carries in your store, sets a higher minimum age, that higher age applies instead. We do not ask for your date of birth and therefore cannot verify your age.

A game account is created automatically and anonymously when you first start the App — no sign-up is required. Your progress is saved to this account (locally and in the cloud, see Privacy Policy §2). Chat features are additionally limited to approved Alpha testers; signing in with an email Magic-Link is optional and only applies where that option is offered in the build.

Three things about your account are public to every other tester: your display name, the power value your account reports, and a stat sheet of your equipment — slots, levels, rarities and aggregated substats. They appear next to your chat messages, on the Power Rankings list and on the profile others can open from a chat line. Currencies, progress and inventory are not public. If you would rather not appear in the rankings, write to hello@optionalindustries.com.

We have zero tolerance for objectionable content or abusive users.

These rules apply to everything you write that another player can see — chat messages, your display name, and the name and tag of a clan you create alike. A display name, clan name or clan tag that breaks them is treated exactly like a message that does: it is changed or removed, and repeat offenders lose chat access.

Messages are filtered before they are posted. Content that targets someone's religion, race, sexual orientation, gender, or national or ethnic origin is rejected outright and is not posted at all. A rejected message is kept on our servers together with the words it matched — that record is what makes a later suspension explainable and challengeable. It is never shown to other players (Privacy Policy §2).

Reporting offensive content

If a chat message, a display name, or a clan name or tag breaks these rules, report it to report@optionalindustries.com. Include the sender's display name, the message text (or the clan's name and tag), and roughly when you saw it — that is enough for us to find it server-side.

We respond to every report within 24 hours. We confirm every report by replying to your email, and we tell you what we decided about it.

If we act against you

If we remove a message of yours, reset your display name, rename a clan you created, or suspend your chat access, you can ask us why: write to report@optionalindustries.com and we will tell you what was removed, on what ground, and whether a person or the automatic word filter made the call. You can contest the decision by the same route, and we will look at it again. A suspension is shown to you in the app when you try to post.

Nothing here takes away your right to go to a court or to a competent authority instead.

4. Virtual Items and Currencies

The App contains virtual currencies and items — for example Coins, Gold Nuggets, Gacha Balls and Skill Tissues, along with equipment, skills, mounts and Numbies (pets). These:

Bug reports, suggestions, and feedback you provide (via Discord, email, or in-app channels) may be used to improve the App without compensation. You retain ownership of your ideas but grant us a non-exclusive license to incorporate them.

6. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT:

7. Limitation of Liability

To the maximum extent permitted by law, Nikolaus Renato Petr (trading as "Optional Industries") is not liable for any indirect, incidental, or consequential damages arising from your use of the Alpha build, including but not limited to loss of data, device damage, or lost progress.

8. Termination

You may stop using the App at any time by deleting it from your device. Request account/data deletion via email at any time (see Privacy Policy §6).

We may end the Alpha test at any time, with or without notice. At end of Alpha, all server-side data will be deleted, except for a small Alpha archive for the Hall of Fame (no game saves), which is deleted no later than 12 months after the public launch — see Privacy Policy §2, "Alpha archive".

9. Governing Law

These terms are governed by the laws of Austria. Any disputes shall be resolved before the competent courts in Vienna.
