Closed Alpha. These terms cover the invite-only test build of numbup. A separate document will govern any public release.

Terms of Service — numbup Alpha

Effective Date: 2026-06-03 Replaces: Version of 2026-05-16 Build Type: Closed Alpha — Test Only

By installing and using the numbup Alpha build, you agree to these terms.

1. Alpha Status

numbup is in active development. The Alpha build:

May contain bugs, crashes, or balance issues
May change drastically between updates
May have its data wiped at any time without warning
Is not feature-complete and should not be evaluated as a finished product

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Alpha build on your own personal device, solely for testing purposes. You may not:

Distribute the App or share your TestFlight / Internal Testing invite without permission
Reverse-engineer, decompile, or modify the App
Use the App for any commercial purpose
Use the App to harm, harass, or defraud others

3. Account and Conduct

A game account is created automatically and anonymously when you first start the App — no sign-up is required. Your progress is saved to this account (locally and in the cloud, see Privacy Policy §2). Chat features are additionally limited to approved Alpha testers; signing in with an email Magic-Link is optional and only applies where that option is offered in the build.

In World Chat you agree to:

Use a respectful display name (no impersonation, slurs, or commercial spam)
Communicate respectfully (no harassment, hate speech, threats, or doxxing)
Not share other testers' private information
Not post illegal content
Conduct discussions in English or German (so we can moderate effectively)

We reserve the right to:

Remove any chat message at our discretion
Suspend or revoke access from any tester who violates these terms

4. Virtual Items and Currencies

The App contains virtual currencies and items (e.g. coins, gems, tickets, equipment, skills, mounts, pets). These:

Are managed server-side and have no real-world monetary value
Cannot be purchased, sold, transferred, or redeemed for money during Alpha (no in-app purchases are active)
Convey no ownership right or entitlement — they are a revocable part of the test license (§2)
May be rebalanced, changed, or wiped at any time as part of Alpha testing (§1)

5. Test Feedback

Bug reports, suggestions, and feedback you provide (via Discord, email, or in-app channels) may be used to improve the App without compensation. You retain ownership of your ideas but grant us a non-exclusive license to incorporate them.

6. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT:

The App will be uninterrupted, secure, or error-free
Saved progress will persist across builds
Any specific feature will exist in future versions

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

7. Limitation of Liability

To the maximum extent permitted by law, Nikolaus Petr (trading as "Optional Industries") is not liable for any indirect, incidental, or consequential damages arising from your use of the Alpha build, including but not limited to loss of data, device damage, or lost progress.

8. Termination

You may stop using the App at any time by deleting it from your device. Request account/data deletion via email at any time (see Privacy Policy §6).

We may end the Alpha test at any time, with or without notice. At end of Alpha, all server-side data will be deleted.

9. Governing Law

These terms are governed by the laws of Austria. Any disputes shall be resolved before the competent courts in Vienna.
